Can you tell me about Texas Foreclosure Law?
I can remeber the first time a customer stuck me for the bill of a complete
system change out (about 5300.00), But the look on their face was priceless
when I showed them on my work order that do to failure to pay for said work.
I have the right to repo the unit. When they arrived home and saw me cutting
loose the condensor unit, they flipped out. Well about that time the
constable show up with the request for payment an they said they don't have
the money. So by Texas law I had the right to remove the items for the
premises or the officer would have no choice but to let me file theft
charges. The officer also advised me that I could also apply a mechanics
lien against the home for the rest of the balance.
My motto: Quality Service,Quality Equipment or a cheap price, Now pick
which two you want?
The law in Texas provides that the service guy can file an M&M lien
and then foreclose on the property. He will be paid from the proceeds
of the foreclosure sale for his improvements. It does NOT provide
that you can remove an installed system. That could get you in big
trouble unless you have a contract clearly stating so. Judges in JP
courts are often not lawyers and seldom know the law.
