Question: Bankruptcy & Judgement & Credit Report
We filed for Ch. 7 bankruptcy and obtained a discharge.
We included our home in the Ch. 7 bankrupty (a first and second
mortgage).
About a year after discharge, the first mortgage company proceeded to
foreclose. We received the standard "court" papers (saying we were
going to be sued in court, etc.) but we were advised by our lawyer that
any judgement would be "in rem" and be against the property, not us
personally, since we obtained a discharge from both mortgages.
We recently started the process of repairing/restoring our credit and
noticed a "civil claim judgement" on our credit report for the value of
the first mortgage.
Can anyone offer advice on how we can proceed to correct this
situation?
