Mortgage Payment Quote
I have a bank mortgage with a major high street bank and they have sent
me a letter stating clearly and unambiguously that the monthly payment is
£x and that they will collect this by DD at the end of October. The same
month they collected £x+35 by DD and my account was overdrawn. I have
spoken to them about it but they will not budge, claiming that the
misinformation wasn't their responsibility. I'm livid, who can I turn to
now?
Is it a newly arranged mortgage ?
I found when I remortgaged with the Halifax around April this year that
they count part of the month in which you took the mortgage out in
addition to the monthly payment (if you know what I mean), ie. 5.5 weeks,
rather than 4 weeks (assuming a month to be 4 weeks for the sake of
example). They did the same with the house insurance too IIRC.
Might the additional £35 be buildings insurance which is collected
via DD, but not included in the mortgage repayment quote that they
gave you.
You need to show a representation. (Well, there is one)
Reliance (You would not have taken out the mortgage with them)
Detriment. (You could get cheaper elsewhere)
In order to force them to go back to what they originally said.
Then they could argue that they made a mistake and the OP should not be unjustly
enriched.
