debt recovery agency.Is it for me to provide evidence?
t would be greatly appreciated if anybody could advise me on the
following . I have today received a letter from a debt collection
agency chasing an ammount of £109.72 for something I bought in a shop
approximately 18 months ago. I paid for this there and then and now
after 18 months I cannot find the receipt to prove so.
I contacted the collection agency to inform of the above and was
abrubtly told that unless I can provide evidence that the item was paid
for I would be taken to court.
Surely it is not normal for a shop (a printers shop that subsequently
went into liquidation) to allow a customer without an account to leave
the shop without paying!!
I was told in no uncertain terms that this argument would not stand up
in court and they 'hear these type of stories every day'.
Is it for me to provide evidence? I find it hard to accept that if a
peson cannot find a receipt and a year and a half later a company
decides to 'resend' a bill it is my responsibility to provide evidence
of their inability to maintain accurate records and failure to do so
means I have to pay again.
- My suggestion is to call the vendor directly and let him know that you
paid at the time. Find out why he thinks you didn't.
