Debt Recovery Tribunal ?
have negotiated a settlement with a former employer through the employment
tribunal regarding unpaid salary.
I have no confidence that the employer is going to pay up willingly and wish
to take action to recover the debt ASAP.
The amount is just under £1000.
Do I have to wait for a certain period before starting a County Court claim,
and would I have to notify the former employer giving them X days to pay up
before starting such action ?
- you would need to write to your employer requesting the payment giving him
7 days to pay and inform him of the fact that court action will be
forthcoming if he fails to pay ,
have you given them the opportunity to pay , what did the tribunal say did
they set or advise any time scales for you to receive the monies
if you were paid monthly you should expect to wait until the next pay date
before you start any action try the polite approach first
going through the court process can be very long and drawn out and it wont
do your employment prospects any good either if you have to lose time from a
new job for any appearances and you cant claim costs or loss of earnings in
the small claims court
if they are being awkward a statutory demand usually works as this is the
precursor to winding them up
- I don't disagree with the above but it's an easy task to apply to register
the award in your local county court. It is then registered against the
company at the Registry of County Court judgements which they won't want
