Personal Injury settlement questions - Who can help me??
My unsecured debt was accrued when I was unable to work do to medical
reasons. Questions. I live in NY and am going to recieve a small amount of
money for a personal injury settlement. This settlement is in State of NJ. I
was told I am not allowed to disclose the amount to anyone as we settled out
of court. This amount is much less then I owe on credit card debt especially
considering attorney is taking his share and minusing expenses involved. I
dont know if I am legally allowed to keep it. There is a contradiction
between not disclosing it and if I have to disclose it for a bankruptcy. If
you were in my shoes what would you do? What options do I have? I guess I
can ask my attorney these questions but maybe someone else can learn from
this and I can get some added ideas.
Another thing after debt was accrued and a few surgeries I was ordered to
active duty right after 9/11. The cc's were charging me 24% interest,
shouldn't I have been protected by Soldiers and Sailors Relief Act? While on
active duty I had a few more surgeries and was then medically discharged
from service and out of work recovering still to this day. I sent the credit
card companies a registered receipt letter to validate the debts. Only one
company responded and a few just resold the debt so now do I have to
revalidate those?
You need to discuss this issue with your personal injury attorney. He or she
can review the precise terms of the settlement agreement and advise you on
what to do.
