Canadian Visa Credit Card Application, how to use in US?
I am currently on a H-1B visa (my wife on H4) and we intend to pay a visit
back to my home country. I heard that I can apply for a visa as a Third
Country National (TCN) at a US border post in Canada or Mexico and use this
visa to reenter the US from my home country. Could somebody tell me:
1. What is the whole process?
2. Will there be a problem to use the visa I get from the border post to
reenter US from my home country?
3. Do I need to get a Canada or Mexico visa? I heard that If I return within
a month, I don't need a visa.
4. If my visa application is rejected in Mexico or Canada, Can I still go
back to the States?
5. I have filed application for PR. Until when cann't I leave the States? (I
was told that after I get the labor certificate, I should not leave the
States).
1.What is the whole process?
Go to http://travel.state.gov. The procedure is explained there. You'll need to
make an appointment - either through a 900 number, through an 888 number (with
credit card) or through the Web (also credit card), and then go to the consulate
on the appointed date with the required documents.
2.Will there be a problem to use the visa I get from the border post to
reenter US from my home country?
No. You won't need the new visa anyway because you should keep your I-94 and use
that to return.
3. Do I need to get a Canada or Mexico visa? I heard that If I return within
a month, I don't need a visa.
That would depend on your nationality. Call a Canadian or Mexican consulate.
4. If my visa application is rejected in Mexico or Canada, Can I still go
back to the States?
Usually, yes. Just keep the I-94; don't surrender it at the border.
5. I have filed application for PR. Until when cann't I leave the States? (I
was told that after I get the labor certificate, I should not leave the
States).
Wrong. You can leave and come back as often as you want until you file for
Adjustment of Status (I-485). Still a long time from now.
I'm not a lawyer and this is not legal advice.
