I applied for a mortgage with a broker. We are both located in Virginia. I
wrote him a check for the appraisal and credit report. After a few days, I
wasn't happy with his service, and wrote him a letter informing him I was
terminating our relationship and for him to return my money.
He called me a few days later and told me I wasn't getting my money back because
he already ordered the appraisal. I told him to send me a copy of the appraisal
and credit report. So far, he has failed to do so. I'm almost positive that
legally, he must either return my money or provide the appraisal and credit
report.
Other than filing a complaint with the State Commission and taking him to court,
what other avenues of persuasion should I use to get him to return my money or
produce the documents he said he obtained on my behalf. Are there any federal
agencies that might be of assistance?
First, read the contract. If it supports your opinion that you are owed the
money, then file the complaint with the state agency or sue or both. If the
contract clearly says that you are not entitled to any refund, and if you
think that is an illegal or unenforceable contract, see a local attorney
about it. That person will evaluate the contract against state law. If the
contract is not clear, post it here and we'll try to interpret. But even if
we do, you still won't know for sure until you either check with a local
attorney, or file the complaint with the state agency and let them tell you
what they think, or sue and let the judge tell you. This is a contract law
question, and no answer means anything until the contract is reviewed.
Oh. Back to your question. Forget persuasion. Let the state commission do
the persuading.
